Estates and Trusts:
Providing Peace of Mind and Safe Passage for your Assets

Among our primary practice areas is a broad spectrum of estate and trust services encompassing estate planning, asset protection planning, income tax planning, special needs planning, estate and trust administration, related litigation, case evaluation, and mediation.

Estate and Asset Protection Planning

In this changing world of increasing federal and Maryland estate tax exemptions, we draft our documents to preserve as much as possible the ability to adapt to changing circumstances and/or dispositive schemes, even to include post-death changes where appropriate. Asset protection is an important part of the planning reflected in our documents. Nonetheless, we remain mindful and watchful that estate tax planning may return to prominence as the political winds of tax policy change; and we draft our documents accordingly.

Income Tax Planning

Another consideration is planning for the post-death transfer of unused retirement benefits (such as IRA and 401(k) accounts) in a manner to minimize the income tax impact to the recipient. In some cases, the unintended but unfortunate consequences of bankruptcy can be anticipated. Our planning also considers the opportunities to optimize the tax basis in inherited assets in an effort to minimize the income tax cost upon the eventual sale of those assets.

Special Needs Planning

Some of our clients have children (or sometimes parents) who have special needs that will require attention after the care-givers die. We are often called upon to draft third party trusts to address these needs without the forfeiture of public benefits.

Estate and Trust Administration

We guide and assist personal representatives (“executors”) and trustees in the administration of probate or trust estates. In the usual case, this includes the filing of appropriate documents to inventory and then account for the collection of assets, the collection of post-death receipts, the payment of valid claims of creditors, administrative expenses, taxes, and fiduciary fees, followed by the distribution of the probate or trust estate to persons identified in the Will or Trust. In high dollar cases, we prepare estate tax returns, when needed, or when desirable to preserve and carry over unused estate tax exemptions to surviving spouses.

Estate and Trust Litigation

Frequently, the transfer of wealth from a decedent to his or her intended beneficiaries can result in conflict. Disgruntled heirs may challenge a will or trust; income or death tax issues may arise with the IRS or the Comptroller of Maryland; creditors may file disputed claims; or competency issues may arise. We provide litigation services to either defend or attack a Will or Trust.

Case Evaluation

Occasionally we are asked to assess the viability of a case, and discuss with the client the propriety of moving forward after taking into account the emotional and financial costs of doing so.

Mediation Services

Through our certified mediator, we offer mediation services in the Estates and Trusts arena, as well as other areas of the law.
